Understanding Asbestos Regulations in Michigan

Unlike mold, asbestos is heavily regulated at both federal and state levels. Michigan follows the National Emission Standards for Hazardous Air Pollutants (NESHAP) regulations established by the EPA, with additional state requirements administered by the Michigan Department of Environment, Great Lakes, and Energy (EGLE).

Asbestos testing in Michigan must be performed by licensed asbestos inspectors. The state requires specific training and certification for anyone conducting asbestos inspections, and laboratories analyzing samples must also be accredited.

What is Asbestos and Why is it Dangerous?

Asbestos refers to a group of naturally occurring mineral fibers that were widely used in construction materials from the 1940s through the 1980s. Its heat resistance, strength, and insulating properties made it popular in insulation materials, floor tiles and adhesives, roofing materials, cement products, and textured coatings (like popcorn ceilings).

When asbestos-containing materials (ACM) are disturbed, they can release microscopic fibers into the air. When inhaled, these fibers can cause serious health conditions including mesothelioma (a cancer of the lung lining), lung cancer, and asbestosis (scarite lung disease).

When is Asbestos Testing Required in Michigan?

Under NESHAP regulations, asbestos testing is required before any renovation or demolition of commercial buildings, before renovation of residential buildings with more than 4 units, when applying for certain building permits, and when selling commercial property in some jurisdictions.

For single-family homes, testing isn't legally required but is strongly recommended before any renovation that might disturb materials installed before 1981.

The Asbestos Testing Process

Professional asbestos testing involves several steps. First, a licensed inspector conducts a thorough visual inspection to identify suspect materials. Then, bulk samples are carefully collected using proper containment procedures to prevent fiber release. Samples are sent to an accredited laboratory for analysis using polarized light microscopy (PLM) or transmission electron microscopy (TEM). Finally, a detailed report documents findings and recommendations.

Michigan EGLE Requirements for Asbestos Projects

The Michigan Air Quality Division oversees asbestos regulations. Key requirements include notification to EGLE before demolition or renovation projects involving asbestos, use of licensed contractors for asbestos abatement, proper disposal of asbestos waste at approved facilities, and specific work practices to minimize fiber release.

Penalties for non-compliance can be severe, including fines up to $25,000 per day per violation.

Asbestos in Older Michigan Homes

Many Michigan homes built before 1981 contain asbestos materials. Common locations include pipe and duct insulation, floor tiles (especially 9"x9" tiles), textured ceilings and walls, cement siding and roofing, and vermiculite insulation in attics.

If these materials are in good condition and undisturbed, they generally don't pose an immediate health risk. However, any planned renovation or repair work should be preceded by professional testing.
